Guidelines for use of the Motor Vehicle Insurance and Repair Code of Conduct Indemnity Form
MTAA and AMBRA are concerned that automotive body repairers are often being required by Insurance Companies and their representatives (i.e. repair assessors) to use repair methods or parts that differs from that recommended by the repairer.
As stipulated in Clause 7.4 of the Motor Vehicle Insurance and Repair Industry (MVIRI) Code of Conduct:
“if repairs are carried out under a contract between the Insurer and Repairer, where an Insurer requires a Repairer to use a repair method or part that differs from that recommended by the Repairer, and the Insurer and Repairer are unable to reach agreement to that change, the Insurer will provide such a requirement in writing.”
Due to this requirement, MTAA and AMBRA have provided the attached Motor Vehicle Insurance and Repair Industry Code of Conduct Indemnity Form (please follow link below).
By both the Insurer and Repairer completing this form, the Insurer agrees, Pursuant to clause 7.5 of the MVIRI Code of Conduct, to pay the direct loss or liability incurred as a result of the quality, presentation or safety defect caused by complying with repair.
The Motor Vehicle Insurance and Repair Code of Conduct Indemnity Form assists MTAA and AMBRA to provide its business constituent members a degree of protection from potential litigation if the repair is not completed to a standard that the repairer stipulated when estimating repair requirements.
